Are Your Leave Policies Compliant With New Massachusetts Laws?

We previously alerted clients to the three new Massachusetts laws that impact employer leave policies.  The new Domestic Violence Leave and Parental Leave acts have already become effective.  The new Earned Sick Leave law becomes effective on July 1, 2015 -- although some employers may have until January 1, 2016 if their current Paid Time Off policy falls within a narrow safe harbor.

In order to qualify for this safe harbor, an employer’s policy must be in effect as of May 1, 2015, and must include the following: (1) at least 30 hours of paid time off during the calendar year 2015; and (2) leave must be offered to all workers, whether full or part time; employers who do not currently offer paid time off to part time workers may add those workers to their policy to qualify for the transition period.

In the past several months, these new developments have prompted many employers to update their policies, employee handbooks, and workplace postings to ensure compliance.
